Commission Regulation (EU) 2024/2619, published on October 8, 2024, introduces significant changes to European legislation on maximum residue levels (MRLs) for certain active substances, including fosetyl-Al.
Starting April 29, 2025, a new residue definition will come into force:
the previous description as “sum of fosetyl, phosphonic acid and its salts, expressed as fosetyl” will be replaced by
“phosphonic acid and its salts, expressed as phosphonic acid.”
This change aims to better reflect how phosphonic acid enters food products—primarily through the use of agricultural phosphonates, fertilizers, or natural environmental presence.
What does this change mean?
The default MRL of 0.01 mg/kg will no longer apply to fosetyl, as it is now excluded from the residue definition.
Toxicological assessment will be based solely on phosphonic acid and its salts.
And at TestQual?
Fosetyl, as a pesticide, will continue to be evaluated in our proficiency tests.
Phosphonic acid will be reported under the new definition, as established by the regulation.
As of April 29, all result reports will reflect this updated interpretation in compliance with current EU legislation.
